although he has his conditional green card now for about 1 year, is it possible for him to have his status changed if we don't go through with a divorce and if i don't show up for the meeting that will up lift the condition? I spoke to someone from the mosque and he told me that we have to be married for 3 full years before the condition is removed, can someone tell me what can be done? what if i want the green card revoked what can i do? he says i can do nothing about it.

all you need to do is get your lawyer to file a form with immigration whereby you state that you no longer want to petition your husband for a green card...since u are the petitioner and you withdraw ur petition becuz ur husband hasnt gotten his permanent 10 yr green card....the immigration will deny him permanent residency since you are no longer his petitioner....
another way you can prevent him gettin his green card....by simply not showing up for the interview or providing any evidence....without u present at the interview...the immigration officer will not approve his case......

Whoever said that you can't get your husband's green card revoked is wrong! (They should probably stick togiving Islamic Law advice and leave U.S. law advice to real lawyers!) You can do it by going to your local USCIS office and writing out a sworn statement saying that the two of you got married for the sole purpose of obtaining a green card for him. Of course, as a participant in a fraudulent marriage, that course of action could subject you (and him) to 5 years in prison and a $250,000 fine, especially if you accepted money in return for marrying him. If you cooperate with them and tell the truth when the USICE agents (immigration police) interview you, more than likely they will just try to scare you and not press charges against you.

However, if you entered the marriage in good faith, but found out later that he entered it just to get the green card, they will not prosecute you and he will still not get his green card.

He will not be able to apply for a permanent green card until within 90 days of its expiration date (two years from the date of issue.) It can take anywhere from 90 days to more than a year to be interviewed after that (depends on the backlog at your local CIS office.)

If you don't show up for the interview and the two of you are not divorced, he will not be granted a permanent green card! The District Adjudications Officers are not permitted to conduct the interview for a married person if their spouse does not attend. (There may be odd exceptions, such as if the spouse is in a coma...) Even if you are divorced, due to the short length of your marriage, the odds are against him getting a permanent green card unless he provides the DAO with a substantial amount of documentation demonstrating the validity of the marriage (documents that show that your lived together and that your finances were comingled, such as joint bank account statements, leases, bills, child's birth certificate listing him as the father, etc.)

He can apply to have his status made permanent if he can prove that he entered into the marriage with full intent, but you made it impossible to continue. He might also succeed if you are temporarily separated but intend to remain together. He will not succeed if you write to CIS telling them that you have tried to make the marriage work but have recently learned that he married you only for a green card.

If you need advice, please don't ask at the mosque. Ask people who really know, such as your closest USCIS district office. There are also community-based, non-profit organizations that may be able to assist you.

If you love him, do not hurt him. If you do not love him any more, is not it enough for you to separate from him? why you want to destroy his Life? If you hate him, hate will destroy both of you. Just decide on this separation is temporary or permanent then decide on what to do.
