you need a divorce. anullments can only happen within 5 years after the marriage, and only for certain reasons, such as it was a shotgun wedding (cohersion) incest, one of the spouses can not live up to the duties of marriage, one of them lied about something important to a marriage, or they weren't the proper age. he is good for divorce because they have been speareated for so long, however, just because they are legally separated does not mean he is not still counted as being married. he needs to fill out divorce papers before he marries you, as well as have them finalized and oked by the courts. he can go to the courts, tell them he can't find her, and they will begin looking for her. if however, they already got divorced, and you are speaking of a church anullment because he or you iscatholic, than i would suggest talking to a clergy member. and yes, there is a difference between church anullments and legal ones.

Are they divorced?
An annullment is two different things when you are talking about getting married in a catholic church.
If they are divorced then yes you can marry but not in catholic church without the annullment.
If they aren't divorced then no you cannot get married, he needs to take care of that first.

You need to find her to get it annulled. I think there is a way to do it with out her being around but, you need a lawyer if he has been married all this time she still has rights to his stuff it could get very messy. I would put everything house etc in your name to protect it from her. Also if he has any type of a retirement plan she maybe able to go after a percentage find out the law in your area.

It couldn't be annulled, it would have to be a divorce, at least as far as I know...that could just be in my state...My mother-in-law "married" the man she is w/ now, but it turns out the marriage wasn't valid b/c he hadn't formally divorced the first wife and she had been gone for a long period of time also...thats a tough one...you should do an internet search for marriage laws in your state and county. Good luck.

No he needs to get divorced if you are in UK. He is still legally married. It should be an easy thing to do. Contact a solicitor for advice.

No he must get a formal divorce. There are procedures for this type of case, and he will need to contact a divorce lawyer.
