You may have to keep the car and chalk this up to lesson learned. Here is the problem. You bought the car and accepted it as is. At that time you found nothing wrong with the transmission. Here's the problem you drove it for 25 days. The dealership has no way of knowing if it was you that caused the problem. If the car had a 30 day, warranty or an extended warranty which usually covers the drive train. The dealership does not have to take the car back or fix it. They will take it back but want to charge you for the use of the car, and the cost to fix the transmission. They are not legally bound to fix, or take the car back. You would only be wasting your money by getting a lawyer involved. Look at your sales agreement, and/or warranty papers. It should outline the dealerships return policy, etc.
Because you drove the car for 25 days, the car has decreased in value. charging you rental and mileage is how the dealer covers that. Why don't you try and negotiate with the dealer. split the cost, what about a different car. The dealer may be more flexible, and apply the $1000.00 to a different car in good faith.

So, I am assuming that the dealership let you return the car and instead of refunding you your entire downpayment monies they took $250 for the use of the vehicle. Yes, they can charge you a daily usage fee and/or mileage fee...it should be in writing on either your contract and/or purchase order. I would call the dealership and ask where this usage fee is disclosed at. This story sounds a little funny though...why would they take it back if they didn't hear anything? Normally, the only reason a dealership would take a car back was if they couldn't receive funding on the loan or if there was a major mechanical problem. Is this a used car? I would see where in writing they justified this usage fee they charge you.

20 cents a mile and 20 bucks a day! Are they out of their minds! You are supposed to be charged 10 cents a mile for drive over a certain number of miles on a LEASE. A finance is yours, whethter you have payed it off or not. Where they rude? If so, don't put up with it for more than 3 services. I had to sue Princeton BMW because they couldn't fix a squeaking noise after 8 times giving it for service. only 3000 miles and 8 months before we got a new car. you could sue, especcially if you know others who feel they are getting ripped off. Thats what happened with me. This dealership was racist and rude. Try going to another dealership

You can go on line and find a good Lemon Law firm to take your case, you have 18 months or 18,000 mile to file a complaint. Look for a Lemon Law firm with a high % rate of winning, you should not have to pay a fee up front if you do get another attorney firm, recommended the Law Firm of Krohn and Moss.
It sounds like you purchased a Lemon.

To me it sounds like they didn't have something completed ... Were you financing this vehicle???? If so they then allowed you to return it? You should be able to get full refund if financing did not go through. You can be a pain in there backside and they should give you back your money.

call the better business buearu your state may have the lemon law or if not they can guide you in the right directions or contact a win win lawyer
