If you picked it up from the floor - no. If you took it from a table and put it in your pocket while nobody was looking - no. If you came up to a teller and told her "I'm gonna blow your f*** head off if you don't give that pen to me right now!!!", that would be considered idiotism, and your place would be in a mental clinic and not here. If you made an underground tunnel on the weekend, and got inside and stole the pen, that would be a different form of idiotism. If you came inside with an army of gangsters, robbed the bank off the money and used bank's pen to write how much you stole, and on the way out put that pen in your pocket, that would be considered a robbery.

if you stole enough over time it could be considered petty theft, you'd have to steal a lot of pens though....how ever i got the feeling this was ment to be a joke and rest assured its funny and i'll be asking them about it.

no it wouldn't. i just quit my job at a bank and everyday customers would steal pens. that's why we would give the crappy pens to customers and hide the good ones for ourselves.

If you intentionally took it then it is stealing but you mistakenly left the bank with it, its not stealing
