yes it's perfectly legal. he can marry her there or here and either way she will be able to come home with him. and once he meets her in person he may completely change his mind. right now he's in a very tough situation that no one can even begin to imagine what he's going through. i used to date a man in the army we split because he did some pretty crazy things while deployed (i.e. started having sex with a girl in his unit who wound up pregnant and she's totally not even close to his type then asked for leave to go home for two weeks to marry her which they granted) once he gets home from iraq and goes through demobilization he may completely change his mind. i wouldn't stress it until it happens. and it would be completely legal. i'm more worried about your ex husband and whether or not that girl is just wanting a green card with the way immigration laws are these days. anyway my mom used to say it best just cross that bridge when you get to it because sometimes you never make it to that bridge and you wasted your time worrying about the bridge you never made it to.

HI....Just to answer your questions. Yes your "ex" can marry her and it can be completely legal. What he would have to do is, as soon as he comes back from over seas he should file for a fiancee visa. She would have the liberty to come and go from Mexico to the united states for 60 days. The only problem with that is that they would have to marry with in the 60 day period. THAT IS IF SHE IS IN MEXICO!!!!! (also it takes a minimum of 6 months to get this visa) If she is not in Mexico he might have problems. If she entered the country in a legal way your "ex" and this girl can get married (no problem) and she could easily within a 6 month time span be a legal resident here in the united states. If she entered the country Illegally they can still get married but there is no way she could become a U.S. legal resident UNTIL some sort of an amnesty gets approved......

Not to be a kill-joy, I bet this Mexican girl has many hooked on her myspace, and will go with the first available male. But to your question, once he gets back here he will (should) have to file for a fiance visa (K-1), and he will have 90 days to marry that girl and start on her status. The good thing (to me) about this particular visa, is that in those 90 days he could really find out if she is really for him, or first availabel. I am not saying that all girls from Mexico or other countries are only trying to secure their status in the United States, but the number of the scammers, greatly out number the ones really in love. He could marry her in Mexico and it would be a legal marriage recognized in the US and then he could apply for her to become a legal resident. He could also get her into the US on a fiance visa and then marry her in the US. Check out www.uscis.gov.

Sounds like your jealous more than anything. And yes, he can marry her legally. It's not going to affect your daughter, as long as the lady is nice. Children only get one mommy, you will never be replaced.

I am sure you will not have anything to worry about after they marry. He will be able to get her the proper documents she will need to be here legally. I do not blame you for wondering what kind of person she is as she will be your daughters step mother. I would hope you would worry no mater who it was he was marrying!

You can't really stop it much, but yea, there's nothing wrong or illegal about it. American citizens get married to foriegn men and women all the time, and thus she will gain American citizenship.
