My niece is 4 and my nephew is 16 months. My sister is not with her fiancee anymore and she is now living with my mother with the kids until January. My sister's ex fiancee lives with his mother again and his mother's house is a pigsty. She actually keeps the styrofoam plate that comes with groundbeef! Her house is a death trap, and they smoke inside the house, I'm not too sure if it is with the children inside, but the children sure smell like pure smoke when I with them. They don't throw anything, and there is trash all over the place. Their crib for my nephew is in the living room. There is trash all over the floor and blankets, and if you were little you just couldn't walk in that room. I have some trouble doing it myself. I know there is mold growing and many diseases in that house. They refuse to let anyone inside their house now, and I think something bad might of happened and their house is unsafe. What can I do about this. I am only the Auntie of these children?

you can call CPS right away an report the house... They can refuse them entrance to the house but only once and they will be back before they can clean it up... They will look through the house and judge it fit or unfit..... and seems to be unfit they will remove the children and take them to the child services where the mother can pick them up... the ex may be arrested for child endangerment and neglect... and yes she could get full custody once all this happens weither or not she works weird hours.. as long as she has someone that can watch them while she is at work... Call RIGHT AWAY>> DON"T WAIT>>> get those kids out of there.. Good Luck

She probably could gain full custody due to unsanitary/unsafe living conditions. Tell your sister to call CPS on her ex. She can tell them that although she wants the father to spend time with his children, she feels that the living conditions are apalling. CPS will award temporary custody to her until the father's family can bring the house up to par, at which time she can allow the children back over there. Unfortunately, I'm not sure who she would be able to get to watch the children while she is working. If she explains to CPS that the father has been watching the children as she works, they may be able to help her find a reliable, cheap or free service for her kids.

Hun, I have a daughter who is gonna be one on the 10th of December, I have also split up with her father and he moved back into his mother's house. Her house is the same way, nasty *** pigsty. Roaches crawling all over the walls and all. about 4 months ago there was an incident where i had not gone for custody of my daughter yet and my daughters dad decided to be an a$$hole and not bring her home after her visit. He decided to tell me he was gonna keep her and she would live at his moms with her. Of course with my mother instincts I freaked out at the thought of my daughter living in those conditions, so to try and get her back before the custody hearing I called Child Services to have them check out his mothers house. I had assumed that by the conditions they would get her out of there, but this was not the case. They told me that just because the house was a mess and her crib was in the living room it wasn't enough to get her out of there. According to them, as long as they have a safe place to sleep such as a crib and food and diapers, there is nothing they can do. I know it sounds crazy and you would think that things like this it what Child Services should be protecting our children and family from, but to them as long as provided food and clothes and clean diapers the children are fine in filth like that!! So I don't think Child Services will do much, sorry. But I did go and get custody and got visitation to where it was up to me where and when my daughter was aloud to stay the night with her father, and since he still lives with his mother, her staying the night with him is non-existent. See if your sister can get some kind of visitation setup like that, they will at least take those kind of conditions into consideration at court, though Child Services wont.

Your sister has to get an attorney and petition the court to not allow the children there until he either moves to a suitable environment or the house is completely cleaned up. There are laws and standards that parents have to abide by if they want their kids to remain in the house. It's an unsafe living environment. But your sister has to be the one to do it.

She should consider herself lucky that she got out when she did, cuz that's just a calling of what her house would have looked like in years to come.

**************

Don't worry about your sister, she won't get in trouble. This is totally the fathers mistake. At this point though, if I were her, I wouldn't allow the child at the house till it is cleaned up. Is there any way she can take pics of the house, inside and out, for evidence to the judge why she wouldn't allow the kid there?

Have you or your sister tried talking to the ex or his parents. Just tell them how you feel and you don't feel comfortable letting the kids stay there. Tell them to do something about it or you will have to get the authorities involved. If they refuse then call social services. I don't know if your sister and her ex broke up on good terms or not but remember, this will have an impact on the kids as well. Just try to work things out first with out the authorities first. Remember, they don't let people in their house because they know how gross it is. If they think they won't be able to see the kids, then it might be the push they need to clean up their act.
Good luck.

Call Child Protective Services!

Why are the children over there so much? Calling child services may get your sister in trouble as well for letting her children stay over there. Now if she decides she doesn't want her children over there and his mother or he make a big deal over it then your sister can call child services to have her reported for custody reasons. But if it is court ordered that the children must spend time w/ the father then she needs to let the courts/child services know the conditions in which they have enslaved her to allow her children to deal with.

Call children services so they can get on them and get them to cleaning that pigsty! The children will be removed if they do not comply with the children services request and will be place with family if they do get removed for non compliance! Do it now and don't regret not doing later!

call social services and let them handle it. If they see that the guardian and the environment is unfit to raise those children, i'm sure your sister can jump in and take custody. Good luck!

you should call family services about the condition of the home. if they investigate and find the problem is bad enough to remove the children from the home, that could justify sole custody.
