Some foreign students are not given visa because the official reckon that they want to immigrate.

Some of the Highly Skilled IT workers can be fast tracked through the Green Card process, it took me 4 years to get mine and some personal expense.

It is tedious to come up here legally and hence the illegal path seems so much easier to so many hopefulls.

Of course you can come legally. The best place to start is the United States Embassy in your country. Competition will be keen since many want to immigrate to America. If you are highly qualified in Information Technology and can get an American company to sponsor you, you stand a reasonable chance. Legal immigrants come to America all the time. Many come as students and eventually acquire a green card, perfectly legally. From the very beginning America has been a land of immigrants, though immigration policy has been restrictive in some periods.

Yes there is. There are annual quotas however for how many skilled and unskilled immigrants we will accept. Most authorities agree that the numbers are far too low to even fill the jobs (especially) unskilled that need filling.
