Contrary to what others have said above, there is no test that can determine when someone is "stoned" based on blood, sweat, or urine. There is no level of marijuana ingredients in the blood or urine that is linked to impairment. None. Someone can test positive even after they have smoked hemp with little to no THC at all.
In addition, marijuana does not cause impairment like alcohol does. One good example was the article done by Road and Track in 1980 called "Puff, the Dangerous Driver". The purpose of the article was to show how bad it is to drive while high on marijuana.
They got two groups of people and gave one group increasing doses of alcohol while the other group got marijuana. The group with alcohol went to pieces right away. After a few drinks they were all over the course.
The group taking marijuana actually got slightly better at the course each time they drove it. Even at the highest doses, the marijuana smokers did well on the course.
In fact, the effects of marijuana are so mild that users find it easy to "maintain" a sober demeanor. Research has shown that they can "maintain" well enough that the only reliable method of determining if someone is currently stoned on marijuana is to ask them.
Overall, there is no evidence that marijuana is a serious hazard on the road -- certainly nothing to compare with alcohol, which accounts for about half of all road deaths.
Moreover, there is recent research which indicates that, overall, marijuana smokers may be slightly safer on the road. This is believed to be because effects are not great and people who are stoned often overcompensate for safety.
This should not be taken as a recommendation to smoke while driving. People should not be impaired when they drive.
You can find a ton of information on marijuana and related subjects at http://druglibrary.org/schaffer Do not accept answers from people who can't provide you with research resources to back up their opinions. If you will do some research yourself you will find that the level of knowledge of most of these people never rises above urban legend and rumor.

Hello,
in answer to this question, Driving under the influence of marijuana.?, I tell you that take a look at this site http://askduilawyer.com it might help you
As you described; "How is it determined if a driver is ilegally under the influence of mariuana while driving a car? with a urin or blood test traces of THC will show up that may have entered the blood stream a month prior to driving a vehicle and having a test. Is there a number or level of THC to determine when a driver has smoked and if he is presently driving under the influence?" it might help you.
All the Best :)

If you are driving 20 mph in a 55 mph speed zone, while eating a burger, fries, and a shake, might be a clue you are stoned.
On a serious note: A blood test can determine if you are stoned, and about how long it was since you last smoked the stuff. This is done by the level of THC in your bloodstream. When you smoke the stuff, it enters directly into the bloodstream, and is measured parts per mill of blood examined. THC disipates through the liver as the blood is filtered, so the number is kind of like a breathalizer test, the higher the number, the more stoned you would be. The urine does the same thing as THC is expelled out through the kidneys, but is not a test that will hold up in court because it has no bearing on when you smoked the pot. The blood however, is a sure test that will get you convicted since it measures how much is in the blood that is traveling through your brain at the specified time the blood was taken. Yes, there is a number they go by, and if you are over that pre-determined number, then you are considered under the influence of Marijuana. Since it disipates over time, the amount in your blood (at the time the blood is taken) is critical to determining if you are under the influence, or its just some that was smoked early in the day. Insurance companies use this all the time to get out of paying off in accident cases, so if you are ever in an accident while you are stoned, then you best not let them have any of your blood. Urine is not that accurate, but blood is a different story.
Glad I could help, Good Luck!!!

I don't know how you failed the field sobriety test and thats the main thing they will use against you, not the urine test. The urine test does not show that you are intoxicated but shows that you have used something. Marijuana stays in ur system for up to 30 days. so if i smokied today and faileed a sobriety 3 weeks from now and they take urine to see whats in it and they find marijuana traces in it. Does that mean i was driving under the influence NOOOOOO!!! urine test only show whats has been in your system.... a blood test will show if you are currently under some influence. The field sobriety test is going to be their number one point used in court

they check for it's presence only since it is a controlled substance. your hair is the longest record, and thc does linger in the blood since ur body deams it a poison and stores it in the fat cells to try and protect ur body. just don't do it ok?

a sweat swab test can be performed to test if a driver is stoned, but it is not often used.
