Yes, it would be considered fraud, and it won't work. The time and date of the accident are noted on the accident report. The insurance company will be able to tell that the accident occurred before the policy was purchased.

Purchasing it after the fact is insurance fraud.
Your friend will end up with two charges. one for failure to carry insurance (Which is going to happen either way) and the other is for insurance fraud which is a felony in a lot of states.
It wont slip past. It would be pretty obvious to the claims dept when the policy is hit as soon as its started.
The police dept has the time of the accident and the ins. company also has the time the policy was issued. Dont try it it wont work.
PS tell your friend to stay the hell off the road if the car isn't insured. The rest of us have to pay a shitload of extra money every year because of uninsured moron's. Your friend had no business on the road ,hence the accident wouldn't have happened.

Technically, the accident happened BEFORE your insurance purchase. So, the insurance binder will usually state a time and date when the insurance will actually be in effect. So, unfortunately there may be no coverage. However, I am mostly spilling my opinion and I hope I am totally wrong, especially for your friends sake. I totally understand the living paycheck to paycheck life!! She just needs to be honest and having insurance at any time is always a smart thing to do.

If your policy shows an effective date of 6:00 P.M. April 25, 2011 then you are covered, however expect them to investigate the claim with a fine tooth comb as this will seem extremely suspicious that you are claiming damage for an event that occurred 4.5 hours after policy inception and there is no way to verify the time the tree falling took place. Also the insurer cannot cancel the policy for any reason. The reason they can cancel has to be an approved reason that they have filed with the state regulator. However I expect they will go over your application win detail to see if anything is misrepresented or you failed to disclose anything. If you did then they will probably void the policy.

The "time" is always noted everytime I have gotten insurance. You can buy the insurance but the insurance company will not pay on a previous accident prior to time of paying. One company would even make you wait until your check had cleared before covering the vehicle.

Your claim is sure to get looked over VERY closely. This would be due to the fact that your friend took out a policy and then shortly after filed a claim. They would then look at the police report and probably compare times of when the policy took effect and the time of the accident. The claim would almost certainly get denied. Is it also a law in the state you live to carry insurance?

Fraud - your policy wouldn't cover anything that happened before you took it out. And if you lied about it and passed it off as an accident that happened later, that's insurance fraud without a doubt. Sorry.

insurance companies note not only the day you got insurance but the time it officially went into affect...this prevents fraud such as the kind your stating...i believe they go by the police report that states the time of accident...now if theres no official police report than you might be able to slide it by if you can convince other motorist to state accident happened after her insurance was paid for
