the mother's already put a man's name on there that she believed to be the father. A DNA test is being taken for viable proof that the child is rightfully not his biologically. I was wondering if anyone had any websites for more information on what needs to be known and done in order to change the name if it comes out to be someone else's and what steps can be taken to see if it's able to get the name changed to the right father's on the birth certificate.

It's my understanding that the father's name cannot be put on the birth certificate unless the father is there to sign it. If the man didn't belive the child was his why sign the certificate. If the test comes back that he is not the father I believe he will have to go to court to have it removed. If she knows who the father truly is then she will have to go to court with him to have the baby's name changed or the certificate changed. You can look in your states statutes at findlaw.com or something like that for the information you are looking for or you can call a lawyer, most will give free consultation over the phone.

you will need to take a DNA test if the other man is not the father to prove you are, that is if the mother denies you are the father, and you would like to know for sure . the General Attorney's office from that point on will help you square away the rest of the details....birth cert., child support, visitation....etc. Check out your legal aid dept. to see where you should start. All of the information will need to be approved by a court judge.

Call your local vital statistics agency and explain to them whats going on.. they will send you the same forms you got when you first filled in the birthcertificate form.. but you will be changing the fathers on the b/c.. as i live in canada it my differ from where you are... I know i will have to do the same thing.. but only to add my daughters father to the b/c as he has been absent her whole life.. but he will be in her life soon so he wants to be on the b/c.. anyways.. in order to do this. I have to have him put in his info and then make a statutory declaration of it, both parents infront of a notary public.. signed, sealed.. and then send it back with the original b/c and they issue and new one.. for a fee.. but i wanted to add his name in her name as well.. but your not allowed to do that.. so.. it sucks..

good luck :)

the laws vary in each state, you could visit the states official website and search for their dept. of record or birth records, or search on google.com with the state name and birth certificate change father's name

You need to research this question in the state where you were born. These kind of laws always vary from state to state.
