My 6 month old daughter lives with me and her father is just starting to show interest in her. There has been an incident before when he tried to take her and I had to call the police for him to return her( all in one day). And he hasnt kept her since then and now he wants to start having visitation in which I dont mind I just dont want to have the same problem. Do I need to go to court to get full legal custody or could I just have him sign a notorized letter stateing that I have full custody and he have visitation rights without haveing any legal problems in case he were to try and take her again.

You can go get a notorized letter but that isn't the best thing here. If he is the father then he needs to be paying support and helping to finacialy as well as emotionally care for this child. For your daughters best interest you need to go to an attorney and get it done. If you and the father agree on everything you can go to the same attorney tell them what you want and have it drawn up and filed with the courts, if you don't then you will each need a seperate attorney. Another option if he isn't paying support is to go to child suppport enforcement and have them set it when they go to court to establish the support it is also in writing that you are the custodial parent and no cost to you.

If he's not a fit to be a father, than take him to court. Most of the time the judge will side with the mother. If you have a real concern for her safety when she's with him, than you need to act on it. Go to court. If money is an issue, than find a lawyer that will work with you on payments.

Go to court and get custody he might still try to take her but he will get into heaps of trouble. Cover yourself and your child if he has done it once there is nothing to say he wont do it again

You have to go through the courts. If you don't he could take off with her and you wouldn't be able to anything because you wouln't have any proof who is supposed to have her. You will have to get a Lawyer just like if you were getting a divorce.

my suggestion is that you get full physical custody as soon as possible! don't tell him either. he may beat you to it. call the legal aid office nearest you and they will tell you what you need to do. good luck hon.
