I was in a car accident today with another vehicle. It was his fault and we both exchanged insurance information but he and I both don't want to deal with insurance if we don't have to. Do we have to file a claim???? My husband wants me to call the guy and ask him to pay for my damages instead of going through insurance but I just think that is wrong. The accident was due to icy weather so although it was his fault, it wasn't intentional...So I don't know what to do!!!!

Filing a claim with Insurance is not against the law, but not filing a report to the DMV is.
Also if he was at fault you better hope he covers cost of repairs. To many are at fault and don't want to file Police report or insurance claim and then refuse to pay, and other person has to sue for damages. Then it turns out they didn't have Insurance.


Best to file Police Report and Insurance claim.

Don't fill out a claim ... your insurance will go up for the next three years ... sometimes it's easier if the damages are minor. I think that it is wrong but it will be cheaper in the long run. If u really feel uncomfortable about it then I would fill the claim .... good luck !!

If you want you can get an amount that would fix your car, and then call the person who hit you and ask for that amount. If they agree and pay you, neither of you would need to report it to your insurance company unless you want to.

No accident is intentional, if they were they would be called "on purposes" instead of "accidents" after all.

you know people flood insur and god knows i just had to pay my prem today i agree if the damage is less or equal to value to fix for both agree i would at least have that a signed mutual agreement but we know the rate is still going up for whatever let it go you were both right as serious drivers good job

without a police report it's his word against yours and he can deny even hitting you and then there is nothing you can do about it, call the police immediately and report it, never leave the scene of an accident without a police report.
