my sons blood father dont want anything to do with hi m and his n ame has never been on his birth certificate is it possible to have my son adopted by my fiance when we get married or atleast make h im the legal father?

The father would have to give up parental rights first. If he doenst respond within a certain amount of time the courts would be in your favor.

The only legal way to do this is to have the biological father sign off his rights. It sounds as if you should have no problem in that area. Then it will go through the courts for a month while he decides if he made the right choice. After the thirty days, your child will be able to be adopted by your fiance. Then he automatically becomes the legal father.

Yes, he should be able to adopt your son. You might have to ask a lawyer or something about it, but it shouldn't be a problem. And if your son's father isn't playing the role of "father", then he shouldn't object when you tell him you want your fiance to adopt him.

Yes you can. It is a very long process, but it is possible (if the Father agrees to it, or if the Father is harming the child in any way)

You will have to go through the court system, to get this to happen.

After you're married, it could be done if the biological father agrees to give up his parental rights. Since your son doesn't have his father's name anyway, why not leave things as they are and go after your ex for child support? Why should he get off the hook, financially, just because you found a nice man to marry? He shouldn't benefit because you marry well. But that's just my opinion. Good luck.

If im not mistaken, his legal father will still have to sign over the rights to the child before your fiance can adopt him.

You can make him the legal father. All you would have to do is get him added on the birth certificate. If you went that route then you wouldnt have to have him adopt him.

I guess so. It seems that it would be easier since that mans name wasn't on his birth certificate. But you may still need him to give up his rights as father so your fiance can adopt.

Yea that would be a good idea, if your future fiance wants to. (if he doesn't then don't marry him) If not then get a lwayer and have the blood dad take a perternaty test and have him pay back child support. If he really is the father then he will have to pay for your lawyer and the test.
