my car is damaged. the other party will not pay me directly they want to pay the body shop directly. i want them to pay me directly. do i have to accept them paying the body shop like this. thanks

No, you don't. You are not required to get your car fixed if you're going through the other person or his insurance. They must pay for the amt of your damages only.

If it's their fault I don't see how they can demand to pay the body shop directly. You should be able to show three estimates for repair and they pay the lower of the three. If they don't want to pay you directly you have the choice of either suing them for payment or accepting that they'll pay the body shop.

Of course the question remains - will they pay the body shop at all? If they don't pay you won't be able to get your car back until payment is made.

They probably want to pay the body shop directly to make sure that you use that money to fix your car and not try to sue them later. You don't have to accept them paying the body shop like that but they don't have to pay you directly either. If you both can't agree, its going to end up in court and the court probably won't be sympathetic to you refusing they pay the body shop.

1. You should have first filed claim with Insurance company
2. If Insurance company won't pay--then talk to party that hit you.
I am assuming the above has happened
3. Legally you must obtain 3 different quotes from 3 seperate auto shops
4. They do have the option of paying the auto shop themselves however I would suggest that they pay the shop first prior to work being done--so you know they won't stiff the auto shop and you have to pay the bill anyway.
5. If they refuse to pay the shop prior to work being done, its time to file in small claims court, and at this point in time--the judge will say payment goes to you

Think about it from thier point of view. You could tell them that it cost you three thousand dollars to get your car fixed when it only cost one thousand. You could try asking them to pay you directly if you show them the reciept, if they don't feel comfortable with that, accept payment anyway they will give it.

Is it your car, or is there a legal owner (lien holder) involved. If there is a legal owner, they can make the check out to you and the body shop or just the body shop if the legal owner directs them to do that.

its not the lowest estimate but the average of the 3 estimates that your entitled to. example:
one shop says : $1476.00
snd shop says : $1798.00
3rd shop says : $ 1699.00
total amount
of estimates is $ 4973.00
divide by 3
$ 1657.67 is the entitlement
