Laws and punishments vary from jurisdiction to jurisdiction and state to state. Find a copy of the law you (or the person you are asking about) has been charged under and read it. Some specify a distinct punishment, some call for a range of punishments that a judge can decide.

You (or whoever is charged) needs to get a lawyer to work with you and negotiate with the court. How much room there is for negotiation depends on the person's criminal history, the wording of the law they are charged under, and the circumstances of the crime.

If it is your first offense, anything is possible. The judge can impose jail time and suspend it > you don't go to jail. It gets tougher with each offense. Some defendants are lucky and some are not.

Sorry, not even with a "get out of jail free card". Were you looking for trouble?

I'm sorry you are in jail. Good Luck and may God be with you.
