My husband's car had met with an accident last dec. The occupants in the other car against which his car had collided sustained minor injuries. He took them to the hospital and gave them first aid etc. They had filed a case for compensation in june 2006. The case is being fought out between their lawyer and the insurance company representing my husband as the car had third party comprehensive insurance. My husband has not been involved in the proceedings, he only gets the summons from the court requiring him or his lawyer to be present for the hearing. Till date he has not gone for any hearing as the insurance company has adviced that their lawyers will be representing him. Now we have been transferred to tamil nadu from Karnataka. What are the formalities that my husband should follow before leaving this place with respect to court proceedings or change of address etc.

The key question to be arrived at from the posted query is
On a change of Address how does one go about keeping in mind a court /legal proceeding?

The answer fortunately is relatively a less complicated and simple one. Follow the following steps and you will solve your problem.
1.Upon reaching Karnataka have an affidavit for change of Address made by an Advocate practising in the state of Karnataka. Tell him I want to make "DECLARATION BY WAY OF AFFIDAVIT". Essentially by this document u will be declaring your new address (Tamilnadu address) to be the new PERMANENT ADDRESS from Henceforth and which should be recorded instead of the old permanent address (karnatka). Also ensure that henceforth all legal proceeding (important keeping in mind your situation), records , and all transacation including correspondence should be done with respect to you on the abovesaid address.

Such document is a relatively simple , and quick formating document and should not take time to draft if the details as requested by your lawyer is provided quickly.

Step 2.Upon printing the same in a stamp paper and thereafter getting it notarised ensure that a copy of the said AFFIDAVIT along with a covering letter informing the insurance company that your address has changed and to intimate the same to the court. Make sure you affix a xerox of the said affidavit.

Insurance companies are there to help. Do not be worried just inform the insurance authorities that ur getting transferred to Tamil Nadu. They will guide accordingly. As per my knowledge there is no need for u to involve urself in this matter.
