my ex keeps putting false petitions in ,so i had to get a lawyer im too stressed to keep handling it my self ,i think the lawyer said i can take acivil case against her but thats more time off from work ,so can i claim these fees on my taxes ,its more then $8000. thanks.

No, you cannot. The only legal fees that could potentially be deducted for tax purposes would be legal fees related to the generation of income.

Why did you get back pay? With one exception, the money is included in income BEFORE the lawyer fees (high AGI) and then the lawyer fees are deducted on schedule A for normal taxes and NOT for AMT. If it's a really large settlement, it will trigger AMT, meaning that you pay taxes on the money you paid the lawyer anyway.

i would think if they were for a business deal or mortgage transaction. if they were to get your lover out of lockup for a drug violation or DWI no.
