Can the mother of my children leave the state with out informing me ?

If there is no custody papers. Yes she can just as well as you can do the same. It all depends on the state or country you reside in. I know in California if there is now custody paperwork done either parent can leave the state with the children.

If neither of you have custody, then yes she can as well could you. Legally if neither one of you have custody of the children, either one of you could take them and leave state and there's nothing the other could do until you go to court. If she has custody, then she has to inform you where she's moving.

Law varies by state. I would suggest you call your county Family Court division and they can provide you with answers to your questions. Also, you should be able to access their website to obtain information. You may very well need an attorney. You need to stay in contact and active in your children's lives. If she is able to leave the state legally, you may want to consider moving to be able to see them often. Good Luck

It all depends on the state you live in. In most cases, unless their is an agreement or separation papers with a custody case, there isn't much you can do. What you need to do is get on the phone and ask your local police department, then proceed to follow the advise they give you.

if you have 1/2 custody of the children , no you can report her for kidnapping them and have the police arrest her, if she has left the state the FBI may have to be called in. Good luck!

If you have shared custody, she must first receive permission from the court. If she has sole custody, and you are the legal father, and pay support, she must have permission of the court. If you're the natural, but not legal, father, she can do whatever she wants!

if there is no legal papers concerning custody then yes. if you have shared custody- no. if your worried about it take the issue to court and make it mandatory that she ask permission before leaving the state. congrats for being a dad who cares. my heart goes out to you!

Yes she can. Even if you have joint custody. Would it be right? No. Would it be fair? No. However, she can. It would be up to you to get law enforcement in the new state to uphold your court order. It wouldn't be easy. Have a brother who's been there.

Unless you have a court order that she isn't allowed to. If you're concerned call your local Youth and Child welfare department, and explain that you're concerned and why. Otherwise there really isn't much you can do.
