As a British citizen who is now working in the US under and American social security number...does the british goverment need a court order in order to freeze your pay as an American even though you are a British Citizen in their eyes for failure to pay tax on income earned while working in Gibralter???

The UK Treasury cannot enforce collection of tax debts abroad. No foreign court has the right to enforce anything which purports to be such an order. However, if you return to the UK, and it was deemed a serious enough matter, you could be arrested and charged with tax evasion. Having said that, it would have to be REALLY bad for it to reach that level.

I'm pretty sure they need a court order from the district in which you reside. For someone from the States who moves, you get the court order/judgment registered in the new state of residence and then get a garnishment from that state's court. I would guess something similar would need to be done in your case, but I'm not an attorney. I would also think it would be less simple for an American state's court to register the judgment--they may need to sue you here.

If you are being paid in the US by a US company, only a US court can garnish your pay. I don't know if there is a treaty that would allow a US court to enforce a collection order from the UK. If the funds are deposited in a UK account of any sort, they are subject to UK law. In that case, a UK court could order the funds seized.
