I went to my office last week and informed them I needed to goto part-time starting Monday. Monday night I had my first sleep study found out that in the 8 hr. study I woke up 60 times every hour. I went into work, and worked half a day. Tuesday night was my second study. I have not received the outcome as of yet. I get a work excuse from my Dr. I call my office and find out cause I went to part time I no longer have a job.

Two things here:

1st - I went part time for some personal problems and medical problems.
2nd - This messed them up from going out of town anytime they wanted to. Now they have to find a full time person so they can start traveling.

Do I have any grounds to stand on under ADA or anything??? I do not fill that I should have lost my job over all this.

Chloe....I have had Sleep Apnea for 4 or 5 years now...this is nothing new. The office knows I have sleep apnea.

Probably not. If they hired you as a full-time employee, and you are no longer able to fulfill that role, then they have every legal right to let you go so that they can hire someone who fits their needs. I'm sorry you lost your job, and I sincerely hope you feel better soon. God bless!

Since you went part time without giving them much notice and did not have a documented disability at that time, you may not have any grounds. If you were hired for full time and could not do it, they probably do not have to keep you on staff. You could talk to a lawyer but it would be cheaper to find a new job. Unless you live in CA or have a disability policy, then you can be paid while off if you have a doctors note. Not as much as full time, but better than unemployment.

first, they will fight it and probably win, they will say you cut out early, you dont show up, your constantly late, blah blah etc etc..

yes, i believe you do have a case, but i would contact a lawyer, just dont pay them to ask them a question.
