My fiance is in the U.S. but didn't use the proper channels to enter the country. We're getting married next year but I know this will not give him any kind of legal status here. What can we do to help him obtain citizenship without having to send him back to his country and without having to spend a fortune on a lawyer only to find out he can't help us? I'd appreciate anyone who has some insight on this situation. Thank you!

When you say "didn't use the proper channels", does that mean he entered the US without inspection? Or came in on a valid visa or VWP but didn't leave on expiry of the visa?

Probably the only way to have him remain in the US is to get married and file for I-485 Adjustment of Status, although there is no guarantee that will be allowed to remain in the US.

If he entered the US without inspection, you will need to file I-485A and pay the penalty.

If you chose to marry a person who is in this country illegally, expect a long and expensive immigration battle. You really should consult with an experienced immigration lawyer for a situation like this.

Each state sets its own regulations regarding driver's licenses and IDs. If your friend does not meet the requirement to show evidence of lawful presence, then he won't be getting a DL in your state unless you're interested in risking your job and jail time. Living here unlawfully while evading deportation does not qualify your friend for an EAD or green card nor does his DL from a state that does not check legal status.

If it's feasable you may be able to send him back and apply for a marriage visa. My ex came here illegally as a teen with her family. She was legal when I married her, but we had to pay some extra fees at INS. Laws may be different now though.

Break up with him, let him go back to wherever he came from, and marry a US Citizen!!!! Morale of the story: before you start dating anyone, check his "paperwork" first!
