I was separated from the Navy in Oct 2004, paperwork states March 05. Court Martialed in San Diego for AWOL. OTH was given to me. RE-4 separtion code on my dd214. Now, I need to know if there is a chance for me to get back into the Navy. Possibly a waiver from the service secretary? and that would be? Would writing my congressman help? I need to know what I can do and if there is anyone out there willing to help, please do so. There is more to the story, but what matters right now is what is in black and white, and I need to fix what I have damaged. I regret my actions and I want to do what it takes to get back in. I have to try, I can not be content without putting forth effort. I am willing to share all info concerning my prior enlistment with someone who can help. If your out there, respond. I was suppose to be charged for desertion(for being AWOL for more than 30 days). FYI I was at homport when this had happened and we just got back from Operation Iraqi freedom 2003/ Enduring Freedom. Charges were dropped to AWOL, as expected. And I dont think my LPO, LCPO, DIVO will help out being that I have been out for quit some time, over a year. I do have support from my command, in some sense, but I need to fight this RE-4. Please advise.

You are out of luck. The Navy is downsizing and having to get rid of good high-quality people. They will see no reason to take you instead of a proven performer.

You were given an OTH for being AWOL, usually that mean missing ships movement or you went AWOL for a long period, 30 days or have done it several times and command got fed up and discharged you. You can hire a lawyer and they can look at your case but thing is the Navy is trying to be sleeker, if you are guilty of the crimes that you committed and the Navy thinks that you dont fit the mold that they are looking for you are out of luck, Best bet is to get hold of previous LPO, LCPO, Division Officer and Department Head, if they think you are worthy cause they might defend you but if you were rated low on evals might have problem. good luck

It is a rough question that needs to be directed towards a Military Attorney. Look in the back of Navy Times or the Yellow Pages for the right kind of Lawyer, then contact one and try to schedule a consultation. Run your story by them and see what they think. You may have to go to more than one, but then again who knows as it really depends on intimate details that you do not need to be fanning out to the general public.

BTW...

Recruiters may not be of much help, if any, and are not experts in such matters.

Go to a Attorney that specializes in Military affairs.
