my sister said we had to wait 40 days until we could split the money? now the 40 days are up and she wont call back ! i called the bank and the account is closed. she filled out a form with the bank with out telling me, and the money is gone. does anyone know where i stand, do i have any rights, is this legal???

You need to call for help from and ATTORNEY _now_. And you can do -exactly- that if you visit http://www.casepost.com right this minute!

well if your mom is alive...she's entitled to all of it. If she isn't then you have an equal right to the estate. In order for her to make the money completely safe, it has to go through probate. And if she hasn't done that, contact an attorney for guidance.

The real question is...how much money is it? If it's a lot, I'd seek the lawyer out. If it's a small amount, you may not want to even worry about it.... I would be more concerned with why your sister kept it from you then actually not getting the money.

The first thing you have to remember is...many people get greedy at a time like this... it's so sad. It can rip families apart and that's what sounds like to me is happening.

If you're talking 100's or thousands...let it go, if it's 5 figures or more...claim your share...but either way,,, your sister is lost

my father did this same exact thing when my mom passed away. He took all the money for himself after saying we would split it as a family. Our family was the one he ended up splitting. I moved out & did'nt talk to him for 3 years. I hated him for what he did. I still do.
Sometimes, in life....there's more than just money. That's why, after not seeing him for 3 years. I decided to forgive & forget. That was 7 years ago. Today, i still am trying to forgive & forget.

This is a big deal. You should contact a lawyer & take her to court. Make sure the judge knows what she did so then the judge may decide she should not any part of the money.

I am sorry that your sister would do this to you at a time like this. All I can tell you would be to contact the bank and get the last 2 months worth of statements and talk to a lawyer if your sister won't return your calls.
