I have a friend who is in jail for child abuse...breaking 6 month olds leg ...she will be in there for 4 years can she still get custody of her children? The motherinlaw has full custody of 2 out of three of the kids....She was smoking marijuana at the time of her arrest also...

It depends on the judge / system / state. Once a child has been placed in protective custody, which I am hoping this is the case, she will have to do lots of changing / bettering of herself / therapy etc. If the courts do not have "custody" of these children and the MIL does, then it's going to be a hard fight. Also, whether she gets her children back or not, she will never work in a day care center / for the state / schools / etc also will never be able to foster or adopt other children..

I am surprised that the decision has already been made that she will be allowed visitation. If I were the grandparents, I would ask the Judge to add a clause into the visitation order, that she drug test before any visits. If the Mother in Law has FULL legal custody, it will be up to her to make the rules, and I hope she doesn't let the kids out of her sight. This is so sad. It won't be easy for your friend to regain custody. She will have to prove to the State she is competent.What a mess!

The only way the will allow that is if when she gets out she will have to go through parenting classes and counceling... In most cases they like to see the mother change and raise her children.. But if the mother in law fights it then she has a really good chance of never getting custody of her children.... and she could only get custody of the one since your MIL has full custody of the other 2..... the most the mom could get would be supervised visitation with her children

As long as her parental rights have not been terminated, then she has a chance to get legal custody. The key here is that she has a chance. Also, if legal custody has not been assigned to anyone else while she's in prison, then it legally reverts to her when she gets out (after all, it is her child).

To prevent her from getting immediate custody, someone else must legally get custody of the children, and they'll need to retain a lawyer to monitor whether the mother tries to regain custody.

I hope to God she can't still get custody. If she can there's no justice in this world. What monster breaks an infant's leg? There should be a one strike and you're out rule with regards to child abuse.

I hope not.

I have a 7month old and if I hurt her like that I'd just go ahead and kill myself.

Marijauna, despite what the commercials may say, does not affect your judgement to the extent that you don't know right from wrong. You might care a little less, but you still know.

I hope she doesnt even get visitsation rights.....jesus if the kids are bugging that much I'm pretty sure there's another alternative besides breaking legs!

well i hope not if she broke a 6 month olds leg that's sad she still new what she was doing but i hope she dont get her kids back but i doubt they would give them to her...
