ok my babys dad does drugs and he's in rehave and after he gets out he want him back and i don't know what to do.

He probably just wants to get out from under the child support payments, and that's the way to do it. If he gets custody, then you will have to start paying child support.

Just because he's out of rehab doesn't mean he's ready yet.

The burden will be on him to prove he's a better parent. The burden will be on him to initiate any legal court action to obtain custody, since it's already legally in your hands.

He will probably try to use any "ammo" he may have against you in court, plus lie if he can't find any "ammo."

Sometimes it comes down to who has the most money to pay the attorney to create the most paperwork. The more money someone has to pay their attorney, the more paperwork the attorney can create to send to the other side requiring a response. If you can't afford to pay your attorney to respond to that paperwork, you could be in trouble, unless it is as clear as black and white who should have custody.

Its your son also and you've been raising him so this would be something he would have to fight you in court over. He is your sons dad so if you feel he deserves visitation then that is up to you - but if he is just out of rehab he still has some work to do on his life before he is capable of raising a child. Rehab is the first huge step - now he's gotta make sure and stick with it in his own environment, and so on. Seeing his son will help keep him focused on why he done it - raising his son may overwhelm him.

I think that you should talk to a lawyer or legal guidance. They can tell you exactly what to do. But I do not think that you have to worry. I think that if you are taking good care of your boy and do not do drugs or anything like then his chances are basically none because your are clean and he just got out of rehab. I know from experience that courts usually give priority to the mom.

If he can prove he's sober he does have a claim to his child. If you two cannot agree on joint-custody by yourselves, he can take you to court to settle it out.
Stay clean and sober yourself, provide your child with the best possible home environment, and chances are that you'll win-- at least the majority of the custody. He'll still have a chance to see his child, though.
