I was a permanent resident for a couple of years, but I had to move back to Mexico for a job and renounced my residency. Now, we want to go back to the US but we do not know how easy it will be to get a work permit. I suppouse that I can go with a tourist visa and then apply for the residency, but I am not sure if it is possible to do that. Any help will be appreciatted.

No, you need to file IR1 (not sure if K-3 will work after years of marriage--read the link below) and re-establish residency.

You say you "renounced" residency. That's rare: more commonly it is just lost through non-use.

You can't legally work until you have legal residence. Of course you have a social security card already, and no doubt a driving license: but I wouldn't advise anticipating the grant of authority to work. It should not take too long to do it legally.

You're not supposed to go to the US under visitor status with the intention of obtaining permanent residency. If you do somehow get admitted, you'll have to file for a change of status and I'd do that with a VERY good immigration lawyer by my side or you will get deported and possibly banned and reg flags will forever pop up by your name anytime you cross the border. File for a K3, hope u get approved and you'll be in the states living and working in 6-12 months hopefully.

What do you mean? You renounced your residency? Explain everything to the admitting officer and hopefully, if they let you in apply for a work permit. Good luck!

A non-US-resident/citizen cannot be legally employed without a work permit/ acceptable ss#. The ssa won't issue you a valid for-work ss# either if you have not been admitted to the country for hat purpose.


The good newsthough is that work permits are approved a whole lot quicker han the green card. Just remember that without it you're breaking the law.

You have to show proof of living with your US Citizen spouse for 2 years to USCIS. You can then apply for EAC(Employment Authorization Card) to work in the USA.

Come on, this hard to believe, you have renounced your GC, and now you want work here, were you deported or been in exculsion? you do not need a tourist visa you need immigrant visa, watch out LA MIGRA
