In southeast Ohio or northern Ohio that knows child support law as well as military law?

my husband is enlisted and we're currently paying child support but he's deployed and the state wants to take into consideration all of the entitlements to come up with a baseline to pay child support. Even our BAH. He's talked with his command and they advised him to get a lawyer. I need one to figure out what I need to do next.

Uh-oh...Does this involve a "deadbeat Dad" who wears a uniform of the Armed Forces? If so, the position of the Armed Forces in regard to child support is simple: All military members are EXPECTED to pay child support if so ordered by the court. Any military member who does not meet his/her child support obligations can have his/her military pay garnished.

If you're trying to get child support from a military member, you may be eligible for military legal assistance. Contact the JAG office at your nearest military installation, or you could try the legal office at Wright-Patterson AFB (Dayton area). The phone number for legal assistance is (937) 257-6141. If the court has already ordered child support and the father is a military member who is not paying, you need to contact his commanding officer or his First Sergeant. They'll probably ask you for a copy of the court order/decree, but once they get that they can order the father to pay child support and can initiate proceedings to garnish his pay if he fails to do so.

some states do require BAH and BAS to be considered as part of income. what I think you are running into is all the special pays he is getting for being deployed.. which are temporary in nature. they end when the deployment ends, which means you would have to turn right around and sue to have the CS amount adjusted back downward again.

Might consider calling the closest JAG office and asking them for some referrals to civilian lawyers.
