Honestly I don't think anyone should be. You know it's one thing to take a call where someone asks you to pick up milk on the way home. But when you're trouble shooting a job or having a gabfest with your friend about "who likes who" or discussing at length a family crisis, well, that's just dangerous. That being said this is the problem. My husband can take calls and drive at the same time..without skipping a beat. My 20 year old, too has this ability. I've seen it many times. My 22 year old, however, will not even think about taking a call while driving. I also see on a daily basis morons of all ages, races, male and female TRYING to talk, swerving on the road, not paying attention to traffic. I myself tend to lose focus so I don't carry conversations or make phone calls while I'm driving. Again, I'm fine for the occasional short call but I noticed when I'm carrying a lengthy, involved conversation my focus/consentration shifts to the call. Since we can't allow some and ban others and since most people fail to see their inability then I must side with those who say ban the cell while driving. For everyone's mutual safety.

Nobody should EVER be on the phone while driving. And those who recommend hands free sets are wrong too! Anyone who says otherwise is wrong and they well know it. It's been studied and proven for those of whom need to hear that. If you want to sit there and tell me you can drive just as well while on the phone, I will recommend you get off the road immediately, because you are a horrible driver. People need to quit being so incredibly vain because it costs innocent lives, aggravation, unnecessary damage and you really are no better or more important than anyone else out there. And do we need legislation on every little thing? Why can't people just wise up already? It cracks me up how we try to act like civilization has come so far, yet we're still act so far behind.

New drivers in Texas are forbidden to have cell phones for the first few months of driving.

The fact that the state recognizes that cell phones are a hazard ought to cause lawmakers to ban their use in cars. Unfortunately, our lawmakers fell down on the job when they had the chance to make Texas highways safer.

No one should be on a phone and drive, it really pisses me off when people do that. But in their mind they think they are driving fine, but in reality they can't keep a constant speed, swerving all over, pulling out in front of people, not using their turn signal. But remember, everyone who does talk on the phone and drive thinks that they are driving like they normally do....NOT. These people are a main reason why there is so much road rage, idiots like this.
Oh and to the first answer, its not illegal in all states. Maybe in yours but not in all.
