Me and my girlfriend have a child together but we are not married. Well not yet at least lol. But anyway. Who do you think should claim him on our taxes should it be the person who makes the most money or the person who makes the less. We both have full time jobs.

This is a case where you have to run the numbers.

Since there is a child involved, one of you may qualify for earned income credit. Usually the one with the lower income.

Also, like the others said, its best to have one person claim the child.

Also, assuming that you don't itemize, you and your girlfriend are getting the benefit of claiming the standard deduction for single and head of household.

If you do itemize, then the person that itemizes should NOT claim the child because the other one can claim the child and head of household which usually leads to a bigger combined refund than if you filed as a married couple.

According to tax law the person who pays 50% or more for the care of the child should take the deduction. So if you make more then common sense says you contribute more towards the childs care so technically you should take it. If the percentage is pretty even then it doesnt matter just go with who it benefits most.

The person who makes the most.....however, you cannot claim the child as a dependent unless you provide at least 50% support. You also cannot swap back and forth each year. It also helps if the child is living with you as well.

The person who pays the most taxes and also has less deductions from other sources.
