I thought I herd that somewhere but can't remember. Does anyone know?

Spitting on someone is offensive touching, in most states a Battery, the same as if you punched them in the face. The only difference from state to state is whether it is called Battery or Assualt!!

I have a friend serving 3 -71/2 for doing just that, The oerson he spat on was a policemen. They were trying to aresst him for being drunk.The judge told him the excuse of being drunk did not work in his court. The officer had to go & be tested for aids. He is fine.

What do you call it if the person who spits on you has AIDS? Wouldn't that be a form of assault? Or use of a deadly weapon?

Yes, in some areas it is a physical assault

Yes, many with HIV/AIDS have been charged with assault for spitting on a person.

I know it is in Australia. In particular, I'm pretty sure it's a federal offense if you spit on a police officer.

depending the situation and where you are, it can be a felony...

Do it to a cop and add extra sentencing...
