Recently, my wife involved in a car accident. It is clearly the other's party fault for causing the accident by driving w/out stop at the stop sign. When my wife call police to do a report. The officer show up, and stating that he/she by law does not require to do report. The officer said that he/she just there to make sure both parties exchange information and then left. Now, the other party that smashing into my wife's car claim to his/her insurance that it was my wife's fault. The problem is there's no witness and no report from the officer. If the officer had take the report then I believe the party would not lie about his statement.

Each Department has their own policies on when, how and under what circumstances a vehicle accident will be taken. For example, some Departments insist that if no one is injured, then no report will be taken and information is only exchanged. Some Depts. require the accident to be over a certain dollar amount in repairs and injuries before a report can be taken. It just depends on your police department. You can call them and ask for a copy of their policy on the subject and they should provide you with one. Bottom line is this: It sucks not to have a report because of exactly what you have expressed. In defense of the Police, it's usually he said she said anyway, so the report will only reflect that information. Also, the insurance company is going to make whatever decision they want regardless of whose fault you think it is. Also, I've seen enough sloppy police reports that it would have been better for you not to have had one!!

I don't know where you live so it is difficult to answer.

Most states in USA have a dollar value limit, below which no accident report is required. Hard to imagine that the cop wouldn't have done an investigation and issued a summons to the party at fault.

However, if you called the police, they should have an incident or dispatch (reference) number and you can determine the name of the officer that came to the accident scene. Get that information.

Contact your insurance company immediately. You should have done this already. Follow up with them and give them the officer's name, department name, and the reference number.

Any decent insurance company will properly investigate the other party's claim and ought to be able to refute the claim.

Law Enforcement is not required to complete a crash report unless there is a criminal offense that has happened. With that being stated, every person should notify law enforcement during a crash and request a report so incident s like your do not occur.

Depending on the state you are in and where the accident occurred, that may be correct. The police do not do anything if the accident occurred in A parking lot.The laws in my state if no criminal offense occurred,then they consider it A civil matter and don't get involved.As everyone is required to have insurance,it is now handled between the insurance company's.It sucks,but welcome to the bush administration.

Usually if another car is involved you do have to have a police report made for insurance reasons

In GA were I worked we are required to take a report.

( unless it is on private property, we did anyway)

It's true as long as no one was hurt the officer is correct.
