In most cases yes. The exception however is if the enemy soldier is trying to surrender. However even this has exceptions an example might be that soldier A wants to surrender soldier be is still shooting at you. Soldiers A+B are still targets until soldier B is gone or killed or surrendered with soldier A. But as a rule as if it's armed and not on your side kill it unless ordered not to.

No. The Laws of War governed by the Geneva Conventions do not allow you to just take someones life because they are the enemy. There are a few things that have to happen before that unfortunate event. They must pose themselves as life threatening, to you, your team, or innocent civilians.

You can kill anyone on any side if you do it right. Sometimes you can kill an enemy soldier thats on the right side. War isnt about who's right.

I think your question is vague. Is this a declared war or are you calling any foreign soil a battlefield? The rules of engagement allow you to shoot an enemy solider at any moment during a declared war unless they have notified you of intent to surrender. However, if this isn't a declared war there are seperate rules of engagement depending on the actions of the 'enemy' solider.

This is a rhetorical question right? It has to be no can possibly misunderstand what being on a battlefield and facing the enemy requires.

But...if you really need an answer to the obvious...yes shoot to kill...every time. He sure as heck will be trying to kill you.
