By your or my definition, it probably is. But legally, I'm not so sure. If the person is of another race (i.e., Hispanic), it probably is, but technically, we could have illegal aliens here from Europe, who are Caucasian, and beating them up might NOT be a hate crime.

Is this a serious question? Of course it is. Just because we do no agree with illegal immigration does not give any of us the right to take the law into our own hands. Too, bad, but it doesn't.
I believe the actual legal definition may vary somewhat from state to state, but any crime against any other nationality BECAUSE OF the nationality is indeed a hate crime. We are not vigilantes in this country.

Also, a person has the right to be treated as innocent until proven guilty in a court of law. If one person suspects another of being an illegal immigrant the lawful course of action is to report the matter to the police or other relevant authorities, not to beat them up.

hate crimes are unconstitutional. they violate the 1st amendment. You are charging a person based on how they think. Our forefathers would be fuming right now. Battery against anyone is a shame. I'm white so why shouldn't someone get 20 years for beating me up?

If the person is beat up for the sole reason of their immigration status, then yes it is a hate crime. However, if the immigrant in question is beat up because he just broke into your car and stole your stereo system, then Al Sharpton, Jesse Jackson, and the ACLU will call it a hate crime.

If a person is beating up the other person for being an illegal alien, obviously, they are of another origin then American and the reason they are doing it is because of their "origins".
Hate crime is not solved by hate.

Not necessarily , wouldn't that depend on what the illegal alien did to provoke an attack?
Being attacked by someone different than yourself does not automatically make something a hate crime.
Most actions have equal and opposite reactions.
