minor child is accused of hitting a parked car with rocks..and we are being sued for more that what the car owner said it would be...plus my child at the time was at a sitters...and he was only 4 years old

The statute of limitations is determined by the state where this occured. It doesn't matter if it's small claims or not. It could be 2 or 3 years or more or less from the date of the occurrence.

What state is this in? Also was there any hostile confrontation between the two parties involved(you and the owner)? If not then you should try to settle out of court due to the fact that it will cost both money and time. I'd also find a local attorney and get their oppinion on the situation.

PS.
Unless the kid did some major damage to the car, this guy sounds like a tool.
