The maximum time someone can be held on a s.136 under the Mental Health Act is 72 hours (after which the section lapses and cannot be renewed). However, Act's code of practice says that unless it's absolutely necessary, a police station should *not* be used as a "place of safety" and suggests that police, ambulance service and mental health services agree an appropriate place of safety within a joint protocol - normally this means a room within a psychiatric unit. The code of practice also states that arrangements for the Mental Health Act assessment should begin a.s.a.p. after the detained person has been brought to the place of safety, wherever that may be.
