You do not need a visa if you have never been convicted of a crime and have a round-trip (return) ticket and are staying less than 90 days and your passport is valid for another 90 days AND your German passport is of the machine-readable (OCR) type.

No Visa with machine European Union machine readble passport they have a chip in the back page. 90 days entry granted witout a visa.
If you have a conviction for drug offences in particular or have a Cuban stamp in your passport you will not even get on the plane, other than that good luck with the trip.

What's New?
If you hold a temporary/emergency German passport and plan to visit the U.S., please read this
As of May 1 German temporary/emergency passports will no longer be valid for travel to the U.S. under the Visa Waiver Program (VWP).
here are the country with visa waiver :

The Visa Waiver Program (VWP) permits visa free travel to the US, if you are a citizen of one of the following countries and the conditions mentioned beneath apply to you.
Andorra
Australia
Austria
Belgium
Brunei
Denmark
Finland France
Germany ######## no visa if you have the new passport ...
Iceland
Ireland
Italy
Japan
Liechtenstein Luxembourg
Monaco
the Netherlands
New Zealand
Norway
Portugal
San Marino Singapore
Slovenia
Spain
Sweden
Switzerland
the United Kingdom

Holders of German temporary or emergency passports who intend to travel to or through the United States must either obtain a valid, machine-readable regular German passport for Visa Waiver Program travel or apply for a U.S. visa to travel to the United States.

Germany remains a designated country in the Visa Waiver Program, and its citizens with regular passports, including children's passports (Kinderpässe), may continue to use the program for business and tourism travel to the U.S. German regular full-validity, official and diplomatic passports remain valid for Visa Waiver Program travel, per current VWP passport requirements, and are unaffected by the decision.

Consistent with U.S. entry procedures, as of May 1, 2006, Visa Waiver Program travelers with a temporary German passport should not anticipate permission to board an aircraft or cruise ship bound for the United States. Visa Waiver Program travelers arriving at a U.S. port of entry with a temporary German passport may not receive parole to enter and be denied admission to the United States.
