last year a friend of mine recieved an article 15 for and act that was commited at his duty station invoving him and another chick. well, on sunday i came across some valuable information. she was blabbing to other people that she had lied on her sworn statement as well as the other people that were invovled. when ask why she would lie about something like that, she said that the NCO was being to hard on her and someone needed to drop him down a dew pegs. so her and a group of her friends got together and came up with a plan to get him. so since i have all of this on video record w/sound shoudl i submit it to the 1st sgt. will it change the NCO's record?

k. 4 those wanting more details. the NCO in question was knocked down from a E-6 promotable to an E-4. He had 6 months of extra duty, and his wife asked him to EROD her and the kids back home. it became a big mess, when his wife found out that he was "accused" of inapporiate acts with a PVT.

okay so here is we go. thanks for the advice that everyone submitted. yesterday afternoon i contacted a buddy of mine that works for AFN and she made copies of the tape for me, which was awesome. I owe her my life. but with that aside. i talked to my 1st yesterday and didn;t really give him much info but told him it wa urgent that i speak with him and the BC in private. so i have a meeting in 2 hours. i am so nervous. iplan on handing both of them a copy and letting them know my intention as far as JAG recieving a copy as well. i do believe these ladies need to be brought to justice for what they did because like i said the NCO involved is a good family friend. my husband told him yesterday at role call that we had come across such evidence and he was estatic to say the lease. i talked ot his wife last night as well, she thinks it is the best christmas present by far. i told her i would call her back tonight when i got off duty and let her know the outcome. once again thanks.

If the charges were unjust and someone was punished wrongly, I'd say yes. Depending on the type of Art 15 the NCO career may rest on it. Future promotions for the NCO. If the charge of removed for corrected in his record then the centralized promotion board can't act on it and he could possibly get promoted. Plus the people who lied on their sworn statement should be punished for it. That is falsifying an official government document and perjury. If they are bragging about it then it sounds like they need to be dropped a few pegs as well.

Turn the video over to the JAG office, and let them know how you got it. That way no one can claim it was fraudulently taken. Make sure you talk to a JAG lawyer and not just one of the admin/paralegal people. Then PRIVATELY talk to the 1st SGT about it and what you did with the video. One of the things I can't stand is a lower ranking person trying to get someone higher up in trouble by making things up. The best thing that can happen for them both is you turning over that video to the JAG lawyers.

It will take a lot of courage, but you have to bring the evidence forward to the proper authorities (I suggest taking it to the JAG first, just to keep my own position as protected as possible), and do it ASAP to keep your own nose clean.
Having said that, I think you are culpable right now if you don't bring the information forward.
The conspirators who set up the NCO have committed a serious crime and I would distance myself from them immediately.
Really, what kind of people do you want in your military?
Unless you are without conscious, you must turn in the information right away. That poor NCO.

He was framed and you can help clear his reputation! His career may have been ruined by the conspirators' false statements.
They will be facing charges if you do. Hopefully this does not stop you from turning them in.
Would you want to work under, with, or for someone who lies to get even at someon else for doing their job?
If it were you who was framed, wouldn't you want to have your name cleared?
I would copy it, send one to the 1st Sgt, one to the CO, and another one to legal. (Keep a back-up copy though!!)
Does he know that you have the tape yet?

absolutely. an innocent person has had their reputatuon and career destroyed by a petty person. Put yourself in the other persons shoes. Besides if found out later that you withheld evidence you WILL be charged with conspiracy. can quote the UCMJ article if you like. 19 yrs MP.

Darn right you should turn that in. It is incidents like this that made me glad to retire and escape women in the military. I had a woman try this on me. Luckily the date she accused me I was 60 miles away and everyone knew it.

Contact CID and make a criminal complaint.
Give CID the original copy of the video, give the 1SG a copy and keep a copy for yourself.
Or you can contact the IG and get them involved. (Although they will probably refer the case to CID anyway.)
