was driving down a road and i had the blinking yellow.. then out of nowhere .. SMASH. i got hit by a dark SUV and he took off. I wemt to the hospital via ambulance and have back pain. the police told me i had the right of way but i am wondering ifl my insurance cover my medical ( x rays -cat scan) and fix my car up? i have full coverage but will i have to pay for the deductable since i wasnt the one at fault? i dont know if they found the bastard that hit me but the police found his bumper. please help! if they do find him will him can i sue him for the injuries and damages? please help. i never went through this before.. it sucks.. this also took place in michigan

You would need to call the claims department of your insurance company, only they can answer that question.

Do you have uninsured/underinsured motorist coverage? If so, you shouldn't have to pay a dime. This is considered a not-at-fault accident on your part. You should not have to pay a deductible either and your insurance rates should not go up following the accident either. That's what that coverage is for. The company should reimburse you for renting a vehicle to drive if yours isn't driveable, and should also reimburse for towing if it had to be towed somewhere. Medical expenses generally fall under med pay, so you'll have to check your med pay limits for that. Lost wages is handled differently at different companies. Some reimburse for it, some don't, it just depends.

Now if they do find the other driver your company can go after the other driver's insurance company and do what they call "subrogating the damages", meaning they basically sue the other company, taking the loss of your back and their own back. You could possibly then also sue them for pain and suffering, loss wages, and medical expense.

Best thing for you to do is to call the adjuster that is working your claim. They deal with these things every day and can most likely answer your questions more fully than us folks on here.

My car was hit by a driver that left the scene. My insurance covered it under my uninsured drivers policy. The deductible was less than the regular policy and my premium was never affected. I'm not sure about the medical end of it though. Check if you opted for the uninsured driver policy and see if that will cover you. In my case a witness provided the police with a plate # and my insurance company went after him. They also refunded my deductible when they settled with him. I hope you get to feeling better... Worry about yourself, the car situation will work out!

If the guy did have insurance, your company should sue his company for all claims. You should have a judgement against him for everything including lost wages. If not, your company and you can still sue him and obtain judgement against him under financial responsibility. Of course, he won't have anything if he's really a bad dude and a chronic offender and may not even own the vehicle he was driving. In that case, your insurance will have to pay for your property damage and medical but probably won't cover lost work time.

A friend of mine got hit by a hit and run driver. Fortunately for her they caught the person. You can definitely sue them. You can be reimbursed for any expenses you occur ed and possibly pain and suffering. Your insurance agent can only answer what you have coverage. You will have to pay the deductible if you do catch the person who hit you you can sue for that. I know my full coverage insurance will pay my medical bills.

If you have uninsured motorist coverage, it should cover you as if it was the other person's coverage minus your deductable.

The good news is in most states, they can't raise your rates for it. They will also give you the same "cash settlement" that the original person's insurance would offer. They do it in hopes that they can collect the funds from the other driver at some point in the future.

If you have full coverage, YOU'RE COVERED. If you have a deductible, you'll most likely have to pay it. IF THEY CATCH HIM, you bet your butt you can sue. Leaving the scene of an accident, hit and run, failure to report an accident over $500. Those are just a few of the things the other guy is looking at.

just a thought but do you have ins if so why are you worried if so ask your ins company they even cover you if your hurt and give you a car to drive while did you even tell the co you had a collision yes if you have full coverage dont worry if your uninsured the other car would have to pay for a fact h and run it would be your ins that goes for or after recovery

If you dont find the person who hit you, then you have to pay $500 and the rest goes to your insurance company. for full covage.

If they catch that person, then you have to pay NOTHING! Also you can sue them and get some money. (that person would go to jail for this.)

I am pretty u got police report, so contact your insurace computer with police report.

Hit and run, always their fault!

Most likely you'll have to pay your deductable, but when they recover the costs from the at-fault driver you can get that back. Talk to your agent about what's covered.
