on may 1st 2005..i was arrested in butler county ohio...i was transported to hillsboro ohio....i was charged with 7 counts of misuse of credit card....they are all felony 5..which carries 1 year for each....i have been out on bond for the whole time....ive not heard from my lawyer in 6 months..ive called her multiple times...she is a great attorney..she was a prosecutor for the city of colunbus ohio for 27 years.....they have video's of the man who committes the crimes...he is tall and shaved head like me...but u can tell it is not me...i have tried to ask for hand writing analises
i was in hamilton ohio at the time of the offense..i was fighting with my ex g/f....she will testify for me saying i was in hamilton if she has to..she is being cool about that..she knows it was not me.....they offered me 33 months if i plead guilty....i said F_UCK U...i did not do it...i am scared i could do 7 years ..lose kids and family.....all for something i did not do......WHAT CAN I DO..PLEASE HELP

i have tattoo's on me..on my kneck .arms..u could not see tat's on him in video....i do not $$$to get a new attorney
i am broke...i am not scared to speak..the prosecutor did not want me out on bond..because i live in another county..i asked judge for or bond.he gave me a 2,500 cash bond..i paid and have been out since.....i have been to court atleast 10 times..and i have had a continuance EVERY timefor one reason or another..is there a time limit to have u in court if on bond?....i do not know how they came up with my name...it is not signed on reciept..ive never been there...no i will not plead guilty..yes i will speak my mind very loudly...and i do have a few alibi's..but they have not been worried about them..im really confused

last thing i can think of that would help....me and my ex..was arguing..she called cops...there was polie report made...me and her was arguing around 600 pm...crimes were commited around 745 and 815 pm...i live 2 hrs away from the place where the crimes were committed...i have drove it several times..if i do speed limit..1hr 45 minutes....if i do 80 85..i can get there in about 1 hr.25 minutes or so..i have timed it every time...but..i also had to be back by 930 to pick up g/f from work...i lost custody of my nephew over this ordeal also

I'm afraid you got caught up in the spinning wheel of our blind justice system,unless of course you have alot of $,which seems to slow the wheel down so you can get off.
I would like to know when you got the plea offer,when your lawyer was speaking to you.
You are right to worry our justice sytem as it is now can and will create injustice.
if your great lawyer has not taken your calls or done any work for you in six months,sometimes the longer the better and sometimes once a prosecutor always a prosecutor.
You were arrested may 1st 2005 it is now almost 2007.
They have offered you a plea bargain,those things together tell me they are not sure of their case against you or you'd be in jail right now,of course you can't be sure either.
So when the time comes later rather then sooner a plea of not guilty and a jury trial seem to be in order.You need to trust your peers to believe you,your girlfriend and see what you do in the video's.
good luck on the wheel of justice,a new lawyer might be something to look into also.

First- find out where and when the credit charges were issued -that should be part of discovery (see the movie My cousin Vinnie for an explanation on discovery (it is the law).
Now if you can prove that you were somewhere else when the credit card was used - thats a great start. If you can prove you were somewhere else for a lot of those charges -like work- then you have a real real good chance.
The point is - to strengthen your case for mistaken identity by proving that on certain occasions - you physically could not have been the person charging the card.
This -then would be reasonable doubt- which you can hammer away at. Also find out when the card was stolen or reported missing and where the person claimed to have lost it. Same approach in this case as well. Again - a job that has steady hours and an attendance record of regularity would be extremely helpful - because it is real documentationin the eyes of the court.
I would petition the court - with proof that you called the attorney and ask for a stay as she is NOT a great attorney if she is not getting back to you.
Regardless of the falsehood perpetrated in America - -- that you are innocent till proven guilty.
You would help yourself a LOT more if you went about proving your innocence because it is certainly not in the police's interest to invest any real time in this case - if they can pin on it on you.
Good Luck- I have had experience with the US court system and I have to say -it is not good at all. It is no wonder the biggest money maker the last three years was Corrections Corporation.

You are in a serious situayion here! You are fighting for your life and if your attorney is not keeping in contact with you then she is NOT a good attorney. Time to look for a attorney one and do it quickly. Write her a letter and send it certified, return receipt so you can document her lack of concern for you and your case. Might be a good idea to contact the local and national bar association. She may have had other complaints against her. You might even consider filing a complaint and document EVERYTHING you have done and continue to do to resolve this case. My son went to prison for 32 months and he will never be the same although he is stronger because of it. But he was quilty and did plead out. Good luck.

Sounds like a great attorney! NOT...she needs to be communicating with you, that is her job. She should get off her @$$ and let you know the status of your case, it is you that will lose if she doesn't do her job. If you are innocent, then don't plead. Felons have a hard life after jail and life will never be the same. Hold tight to your principals and let the Lord help you through this. Good Luck

Stand up for yourself. Be brave, and speak your mind in court. Do not be scared, because you can do this. Do not plead guilty, you didn't do what they are framing you for. Don't give in, and resist their attemps to prosecute you.

take the video to court, show it to the judge, and he can see its not you. Then get your lawyer to sue the cops andDa for not dropping the charges when they saw the tapes.
