I do not agree with the above answers.

No, you dont have to apply for your mother and father who in turn would have to apply for your brother.

You can apply for his green card but he will not be able to stay in the country while waiting for it.

The wait time is 10 to 22 years depending on the country of his citizenship.

Depending on how long long he overstayed his visa, as soon as he leaves US he can be prohibited from reentering the country from 3 to 10 years.

I think his overstay could play some role when he will be filing for his GC after the waiting time passes.

You can apply to sponsor him to stay. Expect a very very long wait. Go to www.uscis.gov for further information
