Your Constitution is there to protect YOU and protect other innocent people from being abused by the State. If you grant the police the right to use illegally obtained evidence they have no incentive (NO incentive!) to leave innocent people alone, do they? Look at what unrestrained police power meant to the people of the USSR and Nazi Germany, and still does in places like Cuba or Vietnam. It is not that hard to get a search warrant, they are pretty routinely granted on showing of probable cause that a person is a suspect. Strict observance of Your Constitution (and it is yours!) is the only way that your basic rights as an American can ever be protected. Otherwise, its just empty words.

NO and your question is not logical. The laws regarding evidence-gathering apply to the state. What would be the point of having a law that controlled the state's activities, if they were allowed to break it legally?

They have the good faith exception. In that exception, if the officer didnt know the evidence was illegal, then the evidence is admitable in court.

No. Police should be held to a higher standard than they currently are. They can get away with manipulating and lying to people. Then, they wonder why people do nut trust them. There are some good cops, but I never seem to run into them.

the definations of what is illegal should be changed not the use of exceptions. If it is illegal, it is against the law. Change the law.
