For my birthday yesterday, the army decided to send me this overnight delivery. Unfortunately it wasn't a pretty diamond ring. They are giving me a month to report to Ft Jackson so I can be activated. I served 5 years in the army and one of those years in Iraq. I can not be doing this anymore with the army, they have already taken so much from me and I know that I signed the paperwork saying I'll do a 8 yr committment (which I might add, the recruiter failed to mention). I am just wondering if I can get out for medical? Right now I'm collecting 40% disability, because the army decided to make me damaged goods. And if so, can they determine this before I report or after. I'm not sure if anyone knows the answer to this but I figured I would ask anyway since I only have a month to figure out what is going on with my life. Also, if there is any other options for me, I think I did enough for this country. Thanks

You are going to report to what is called MOBSTAT (Mobilization Station). You must be processed through there. Part of that processing includes a medical review. Bring all your paperwork and medical documents detailing your disability. You will then be screened by a physician to determine your medical status. He will decide if your disability warrants a change in MOS (send you to an MEB board) or if you are unfit for duty and should be discharged (send you to an MRB board). You can not move from the MOBSTAT to an active unit WITHOUT having your medical status declared fit for duty. With a 40% disability, I would all but guarantee this process is going to separate you from the service before you have a chance to move forward to a unit.

Forget all the pay you got while you were in and the pay you're getting now. Forget that the paper you signed had actual writing on it, which you apparently didn't bother reading. Forget that everyone knows to take what any recruiter says with a grain of salt. Forget that everyone I have ever met knows that an initial enlistment is for 8 years broken down by either all active, or part active/part reserve/part IRR--or other combination.
If you have a disability, then odds are you won't be getting a difficult job assignment. You will be put back on active status with pay and benefits--unless you are some corporate 6-figure a year salaried executive, this can be a good thing. If, however, you can get some sort of qualified medical authority to state you do not have the capacity to serve, you will not have to go back in. Be very careful, though. Unless you have it on proper authority that you have been released and are not required to report in, GO report in. Technically, if you do not show up at your assigned reporting point, you MAY be charged with not just AWOL, but desertion since we are engaged in a conflict at this time.
Go, see a doctor, get with the legal division in the Army, and start the ball rolling well BEFORE your report date.

If you are injured or disabled you are more than likely completly non-deployable. But you know the Military by now, getting the paperwork done and getting a medical discharge may take some time. However you need to send a letter to each of your represetatives in Washington. at the senate and the house and tell them about your situation. If you are honest they will be more than willing to help you sort out the mess. If you are truly non-deployable they can assist you in getting things worked out before your ship date to good ole' Relaxin' Jackson.

The best thing to do would be contact your unit that you left from and find out exactly how this can be fixed if at all. Good luck I just talked to my husband and he said that yes they can call you back but you most likely you wouldnt be deployed due to your disability, but that they can use you in other capacities. He also said that it is pretty spelled out in your contract about 8 years. You have to read them before you sign them.

when you report, a determination will be made whether or not you are deplopyable. keep inmind that while you may be deemed unfit ot deploy, than can STILL keep you mobilized on Rear Det if they choose.
