I've heard yes and no to this question so if you could site your sources please. I've seen several on-line sites claiming to be able to and that there is only a law to keep it from being sold in stores in the us.

Ok, I can't really give you sites but here is what I can tell you. In the last year and a half, my husband and I have been to Amsterdam twice and partook in Absinthe the old school way. The legitimate Absinthe (160 proof or higher) is banned from being sold in the States. It's history of causing people to set into a stage of hysteria, madness, dillusions and "trips" is why...the potency of the wormwood is what has the drink classified along the same lines as your daily street drugs. There are all types of proofs...some stronger than others but to get to the illegal stuff you've definitely got to go higher. Whats the point in having and eighty proof replica when all that equals in potency is the same as one normal American cocktail. In some liquor stores you may find a knock off but I would highly urge you not to waste your time. It would not even come close to the real thing. Be weary of these websites...if you don't know much about the product, I'd be a bit hesitant to order. It's probably quite easy for some of them to sell close-enough versions because so many people don't really know. Do a bit more research to ensure that you purchase the real thing.. Hold out for the real stuff - it's very much worth the wait.

You can buy absinthe here in Canada at the liquor stores but it's not as strong as the Czech stuff. That can be brought in through Customs with no problem. This site purports to sell it from New York, you could try it and at worst be out $20. If you get some watch out for the hangover!

Absinthe is legal to own and purchase within the US but not to sell. In Canada, Spain and the Czech Republic, it is completely legal while Switzerland still bans absinthe and other wormwood containing products completely

It is legal to posess in most places, but it is rather hard to come by, unless you purchase it from overseas or make it from your own wormwood plants.
