my boyfriends motorbike was stolen from the garage he took it to for repairs, they told him 24hrs after it was stolen and at first the owner was really apologatic and said he could choose between a replacement or cash to the value of the bike anyway he told him to come bk in the next day to discuss what he wanted to do, wen my b/f went bk there were 2 guys there who said they had changed thier minds incase the bike turned up as they would be out of pocket but surely it does`t matter to them as the insurance would cover it... should i go down and speak to them or go straight to a solicitor

Neither. It's his bike, and he should go file a police report about a stolen bike and let the police handle any details. If he has full coverage insurance on the bike, the insurance may cover his loss. In any case, even without full coverage, contact the insurance and let them know. I don't know what it's like there, but I have what is called "garage keepers" insurance on my business which would cover loss, less my deductible amount. Of course I also have locked gates, video, 6 foot chain link, and 3 strands of barbed wire on the top, and a couple of very noisy little dogs on patrol.

Sounds like in your case the garage owner knew they had done something wrong, but then re-thought everything later. Perhaps if the police contact them and start asking questions, they will re-think it once again and pay.

Here in the U.S., if a vehicle is stolen from a business and the business did everything within reason to secure the property, (like move the bike inside and lock the doors), then they are NOT responsible for the actions of a third party (the theif). Your boyfriend's comp. coverage should cover the bike and he should notify his insurance company ASAP! The garage should step-up and pay the deductible if there is one, however, they cannot be forced to.

Emmaline if your bfs bike was a bit special it could have been stolen to order i have my doubts about the garage owners was there anything else taken or just the bike signs of forced entry perhaps / the police and a good solicitor then the trading standards should sort them out best wishes

Report it to the police - it sounds a bit dubious & they may well not have done so. A good solicitor will tell you they have a "duty of bailment", which is they're duty bound to take care of the bike while it was in their hands. Clearly, they didn't.
Go see a solicitor, you should find one who'll give you an inital interview free.

First, contact the police to report the theft. Second, the garage should have commercial liability insurance with a "bailor/bailee" clause that insures your possessions while they are in their control, that covers them for those types of things. Contact an attorney.

Smells a bit fishy. I'd get legal advice ASAP. Most good legal practices will give you a free 1/2 hour to understand the situation.

When you report a theft of a car or motorbike to the insurers, you have to wait up to 4 months for payment. this is in case the motorbike is recovered in that time.

First call the police and file a stolen vehicle report. Then go to a solictor.

report it to the police now and get some legal advice, dont go down it may be dangerous. it soujnds like they dont have insurance. the worst comes to the worst your bf's insurance should cover it as well as long as its tpft or fully comp
