My brother and one of his coworkers were horse playing at work and my brother stopped for a brief second to answer his phone and while his back was turn his coworker stabbed him in the back so my brother then urn and stabbed him back . His coworkers injury were much more severe because of the object used so the guy had to go to the hospital for treatment they arrested my brother but they haven't arrested his coworker. He has a bond hearing on monday do you'll think the judge will grant him bail and if convicted how long do you think he will be sentenced for?

They do have cameras and the airport police is in the progress of reviewing the tapes. And my brother was stabbed with a pen he was bleeding but not as much as the other guy . The other guys wound was the size of a dime

does your brother have a wound from the stabbing? can he identify the object used?

When it comes to somebody being stabbed, it is no longer considered horseplay. Were there witnesses to attest to your brothers' version of the story? Is the area where the incident occured under video surveilance? Has his co-worker been released from the hospital? Does your brother have a Union?
There are soooooooooo many mitigating circumstances in a case such as this, he'll need to talk to an attorney.
By the way, where, exactly are you asking from? Different Countries, States & Counties all have their version of the law.

It's worth noting that your brother can only plead self defense if he can convince the judge that he believed the guy was about to stab him again, and that the second stabbing would endanger his life. If you hit, stab, or shoot someone just to get them back for what they did, then it's aggravated assault. You don't get any points because "he did it first".

for an assult you have to put the victim in fear off immediate fear of danger that is the definition! if your brothers coworker had injury which involved bleeding this is ABH not assault assult carries 6 months however if racially aggrivated this is 2 years ABH carries. 5 years add 2 years on top if racially agrivated. the judge should grant bail unless he feels your brother is a danger to his coworker!

I dont understand why is your brother being charged what about the coworker who stabbed him FIRST?? I think he should plead self defense

I think that he needs to fight the charges, plead self-defense. And if they insist on charging your brother he needs to press charges against the other guy.

It's assault with a deadly weapon, hope they don'y charge him with intent. If it's cut and dry self defense, i don't think you have much to worry about. I hope you have more than one witness that can prove your story too.
