my boyfriend wants to come and live with me here in uk he tried to get a student visa and that was denied. if we got married would there be a good chance he could stay here? and what sort of things do you have to go through to do this?
we love each other very much and it has been agreed if he really can't come here.I will have to try and go and live in his country. we are willing to do anything so we can stay together. please don't suggest breaking up because that isnt a option.

I am not marrying him JUST so he can get a visa. I'm marrying him because it's wanted to do sooner or later anyway. what does he have to do and what doucuments does he need for us to be able to do this.

there are several types of visas. In order for him to marry you in the UK he has to pay for a Fiance Visa. You can not get married in the UK if he isn't under this type of visa.

You could go to where he is and marry him there; but be sure to verify that marriage in that country is recognized in the UK. Also make sure you get all the necessary documentation from that country to prove it is a valid marriage. Once you do that, he will have to apply for a spousal Visa which will give him two years in the UK to establish himself during which time you have to live as a married couple together.

Just before the end of this two year period, he will have to file for a permanent residence visa through the Home Office. This is where they will investigate you and if you are genuinely a married couple.

Remember, while he can probably come visit on a tourist visa, this will not allow you to marry in the UK - the laws have changed.

I'm sure if you are married, you can sponsor him to get the visa to stay in UK under family scheme. It's one of the easiest way for many countries.

For me, I'm migrating to NZ to live with my bf too. Have explored so many different ways to get visa and stay there, being skilled migrant, work permit, or whatever... and it's not easy, and there are always many criterias needed to be qualified. So after trying to find so many ways, finally the best way is to be sponsored by my bf (which I knew much earlier but wanted to try other ways than to get married for the sake of the visa). Anyway, we made the decision because we are going to get married sooner or later too, so it's better to go by the proper way. I'm sure you can ask the UK immigration for suggestions and they would be able to help. If you two are very sure of each other, then of course, getting married is the best way. If not, don't jump in for the sake of getting the visa.

Not sure which country you will try and get a visa for but... If it is for the USA remember that it is illegal to get married to ONLY establish residency.

I understand that you love each other and if you do a student visa should not be a reason not to continue your relationship. It just may take time to live on common soil.

If your relationship is genuine, your boyfriend should go by the proper channel which is applying for a fiance visa at the British High Comm in the country he is residing. There will be paperwork and your relationship will be scrutinised. You will both be asked to provide evidence of an ongoing relationship. All in all it may take a few months but everything will be done above board and you both will have nothing to fear if there is nothing to hide.

If he's already been denied a student visa it will be on his records and so if he tries to get a visa by marrying you it will almost certainly end in failure. The immigration department will just take one look and say that the marriage is a sham to get a visa.

if he's been turned down once marrying him will just start alarm bells ringing with immigration.

You would have to prove it was a genuine marriage, and they come and check.

Friends of mine had this recently, the husband already owned his own house and all the bills were in his name so when his wife came into the country they left it that way - they are both of the old fashioned "the man looks after the finances, the woman looks after the home" mentaliy.

Well that was all well and good by the immigration people wanted to know why her name wasn't on any of hte bills and was she really living there.

You can bring him here on a conditional visa with the purpose of marrying. He would likely be able to come before actually marrying. If you marry specifically for a visa it is illegal. However, it seems to me you really want to be together regardless. My knowledge may be outdated somewhat.
