because it's much more harmful to the baby, she has a right to have abortion, but when she doesn't want to have an abortion she OUGHT to take care of her unborn baby, law has it right

Seems inconsistent, and I'm not at all saying it's right, but it is indeed consistent with most state laws in the US. Think about it: some states legally kill criminals (death penalty), but they only do so in specific, decided, supposedly swift and painless ways. But to use drugs during pregnancy could harm the development of a fetus and cause it to be born while going through withdrawal, or deformed- basically it is cruel, unusual, and unfair. However, the whole argument falls apart when you consider that an unborn baby is the epitomy of innocence, whereas a criminal on death-row perhaps is not. So, basically you are right- it is nuts.

You are right! That's just a "TINY" bit contradictory. Unless the law is looking at it from a monetary view. If you kill the fetus by abortion it costs you. BUT! If you have a drug problem and the child survives, the child will have a drug problem and that could cost tax payers. I think I figured it out.

Although I agree with you and you bring up a valid point, I still feel that mothers who use drugs while pregnant deserve to be prosecuted. I sometimes work in a Neonatal Intensive Care Unit and watching a newborn having to go thru withdrawals is heartbreaking. The child did not ask to be born addicted. People know better than to do that. Putting your child's health or life at risk before it is born is horrible.

I don't know what country you're in... but yes it doesn't make much sense. I don't agree w/ abortion OR taking drugs while pregnant. However, I believe it's a freedom of choice for a woman to make and one she'll have to live w/ for the rest of her life. I can't imagine it would be an easy decision for a woman to make.. but in the end it's still her choice.
It's frustrating the way things work ... seems backwards most of the time doesn't it.

by taking drugs during pregnancy ur effecting ur child's dev. and he can get severly brain damaged and physicly. u don't have the right to ruin ur baby's life by doing something illegal, just cz u might think u own ur child doesn't make u free to hurt him(u don't own him btw).
When u kill the baby, u take away it's life, ur not damiging him and making him go through life.
I'm against abortion, but it's usually done cz of ppl getting raped, or the child being sick, meaning logicak reasons, and not just feeling like it.

I agree, it is completely NUTS! Similarly, why can the man who killed a pregnant woman get convicted of double homicide yet women can "choose" to kill their baby without consequence. Doesn't make much since to me.

as Dickens said, " the law is an ***, an idiot." There are many such logical inconsistencies in it, because of how laws are generated.
