In FL you can do several things:

1. File a Petition for Temporary Custody for Extended Family Member; or

2. File a Guardianship for a minor without property.

If either is done by consent of the parents then the attorney fee and filing fee ranges from about $1,500 to $2,500.00 depending on the lawyer you hire. If it's contested then you need to do the Petition for Temporary Custody and its going to cost approx. $2,000 retainer upfront and billed out at the attorneys hourly rate ($200 and up) then after the $2k is used up you are billed at the attorneys hourly rate each month until the case is completed.

If #1 is uncontested, is will take about 30 days to complete and #2 can be completed within a week. If contested, don't do the guardianship, do the petition for temporary custody and it can take as long as a year since a child custody evaluation would have to be done.

NOTE: Child custody evaluators can be attorneys or child psychologists. Attorneys generally charge about $2k to $2,500 to complete an evaluation and psychologists fees range anywhere from $2,500 to $5k depending on what has to be done. If you can afford it hire a psychologist, it eliminates the buddy factor among attorneys and quite frankly, just because your an attorney (in my opinion) doesn't make you qualified to evaluate child custody. However, if it's a really good case for you (what I can a no brainer) then an attorney evaluation will do.

You need a lawyer knowledgable in custody matters. Contact your local Bar Association and they can guide you to a choice. In my state they can get you an initial consultation for a fee much smaller than the attorney might charge. You could get a much better idea of proceedures that way. Your circumstances are not clear,other than you have the child.If you want legal custody for the better welfare of the child,contact a
child's advocate office,or a national children's defense org.Try this site for state information in which you live. Be sure you are doing it with all the right reasons behind you.Sometimes the more unconditional love act is to find the best place for him.I'm sure your heart is right,and you will put the best interest of the child first and foremost.What a blessing you are to be in that child's life, to care so much.To be willing and know the strength it takes to be the constant in a child's life.Good luck to you and may God give you the wisdom and finance's to do it.

You are probably better off getting an attorney for this one...You need to go to court and either the parents have to give up there rights or the court has to take them away from them...It will be a long process...

Hopefully, you have documented all of your spendings, time at the doctor, etc... when it comes to this particular gradchild...go to a family mediator (they are found in family courts everywhere) and see what it would take for you to get custody of your grandchild...different situations, call for different cases! A family mediator not only deals with these types of things daily... they also have great resources for you...it is free...give it a go!

Depending on your state's laws, you may have to file for custody through the family court. Different states have different rules, so talk to leagal aid in your area. They will give you advice for little or no money.

I think you will have to sue your daughter (in law?) if she doesn't agree to it, and take your argument to court, proving that the parents are unfit.
