No it makes them a sex offender. Age doesnt matter, don't you remember that story of a man who was sleeping or drunk and he woke to some women giving him a bj (without his consent), in the end she was actually charged and arrested. It isn't your fault though

You become a sex offender when you are convicted of a sex crime. In this case if there are charges brought up against you, and because this person was a minor, regardless of the action of that person, you as the adult would be at fault.

Depends on which state you live in. But in general, YES by many a state law you'd be considered a sex offender and charged with statutory rape because the person was a minor. Age does matter in a court of law.

No it would be rape b/c I was sleeping. I'd be freaked out and screaming it that happened to me. I would sue the person if she/he didn't get put in jail.
