My girlfriend and I are really worried that my homophobic parents will take legal action against her when they realize she will be turnng 18 in June and i 16 in july. From my own knowledge, i thought the law permitted our relationship since there is only a two year difference, but a few days ago, i heard otherwise. A trusty friend acknowledged my situation and said to me that as soon as she turns 18, it can be illegal for us to be together until i am overage aswell. The curiosity and the worrying of the future problems has been keeping us both at the edge of our seats, not letting us even sleep at night, just thinking that my parents could put her behind bars, make her pay a fee, or appoint a restraining order against her. It falls under the equal protection clause of the constitution. It doesn't matter.

I don't know what the law is in New Jersey, but I have never heard of a case of statutory rape that didn't involve a man (or a boy) having sexual intercourse with an underage girl. Anyhow if you both deny everything, nobody can prove different unless they've got you on videotape or something. A restraining order, by the way, is a whole lot of nothing. If you actually read the thing, you'll see that it's like a warning ticket.

All sexual contact involving people under the age of 18 is considered statutory rape. Even if both people are under 18. So really it's been considered statutory rape all along as far as the law is concerned. I suppose it depends on how much your parents know about your relationship. If all your parents know is that you are involved in a same sex relationship then legally there is nothing they can do. But if they know and have evidence that you and your partner are having sexual contact then not only can they take action, but legally they are recquired to try and stop it.

Contact withanyone underneath the age of consent is considered "statuary rape." New Jursey Law, states that she can be charged, and your parents have the right to press charges irregardless of consent issues. There are VERY serious consiquences.

If the person is under the age of consent, she is being molested by the adult Call the Social Services and report her and the situtaiton.

The equality act would see the same outsome as any statutory rape case! rape is rape, man on man, woman on woman! Man on woman, woman on man! Cases would be treated no differently! providing the evidence is there to convict!

Um....she can't 'rape' you, because 'rape' is when one person forces another to have sex with him/her, and in case you haven't noticed, you two can't do that.

By the way, 'homophobic' is an incorrect word. 'Phobic' indicates fear. No one is afraid of you. We just realize that what you're doing is wrong. Please don't yell at me. I just go by what God says.
